Terms of Service

These terms are an agreement between you and E13 Tech LLC, a New York limited liability company ("Colorify," "we," or "us") for your use of colorify.ai. By creating an account or using Colorify, you agree to these terms. Our Privacy Policy explains how we handle personal information.

Using Colorify

Colorify uses automated tools to repair and add color to old photographs. A result is an estimate, not a record of the original colors, and it may contain mistakes. Keep your own copy of any photo you care about. We may change or stop features, and we work to keep the service available but cannot promise uninterrupted service.

• You must be legally able to agree to these terms where you live. If you are not, a parent or guardian must agree to them and supervise your use where local law requires.
• Keep your sign-in details secure. You are responsible for activity through your account.
• One free photo is available per person. Creating extra accounts to claim additional free photos is not allowed.

Credits and payments

• One credit covers one photo. Your first photo is free when you create an account. Packs are one-time purchases, not subscriptions.
• Prices are shown before checkout and charged in US dollars by Stripe. Stripe handles your payment details.
• If we cannot produce a colorized photo or our checks decline it, we return the credit to your balance.
• Credits do not expire, have no cash value, and cannot be transferred.
• All sales are final. We do not offer refunds for unused credits except where a refund is required by applicable law. This does not limit any cancellation or refund right you have under applicable law.
• Price changes do not affect credits you have already bought.

Your photos and results

You keep the rights you have in your uploaded photos. To provide Colorify, you give us permission to store and process each photo, and to send it to our AI service provider, only for screening, repair, colorization, storage, and delivery of the service. We stop using it for those purposes when you delete it, although copies may remain temporarily in backups or with a provider under its own retention terms, or where we must keep them by law.

You may use the results to the extent allowed by law. AI-generated results may not be unique, and the law may not give you exclusive rights in them. You are responsible for having permission to upload a photo and for respecting the privacy and rights of people shown in it.

Things you must not do

• Upload a photo you do not have the right or permission to use.
• Upload sexual or explicit material, sexualized images of minors, graphic violence, or illegal content.
• Use Colorify to harass, deceive, threaten, or harm someone, or to break the law.
• Bypass our content checks, usage limits, or payment; interfere with the service; or scrape or reverse-engineer it.

Automated checks can make mistakes. A declined photo is not charged.

Closing accounts

You can stop using Colorify at any time. We may suspend or close an account if you seriously or repeatedly break these terms, or if we need to protect the service or comply with law. You can delete saved photos in Colorify. Closing your sign-in account does not automatically delete saved photos; contact us to request their removal. If we close your account, any unused credits are not refundable except where applicable law requires a refund.

Disclaimers and liability

To the extent the law allows, Colorify is provided as available, without a promise that it will be uninterrupted or that a result will be accurate. We are not responsible for indirect or consequential losses. Our total responsibility for claims related to Colorify is limited to the amount you paid us in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them, or to liability that cannot legally be limited. Nothing here takes away consumer rights that cannot be waived.

Changes to these terms

We may update these terms to reflect changes to Colorify or the law. For a significant change, we will update the date above and give notice by email or in the service before it takes effect. If you do not agree, stop using Colorify. Continued use after the effective date means you accept the updated terms.

Law and contact

These terms are governed by the laws of the State of New York and applicable federal law. If you are a consumer, mandatory consumer protections and rights to bring a claim in your local courts continue to apply where the law gives them to you.
